New-build homes are normally subject to VAT, which is generally set at 10% of the purchase price, as well as an additional stamp duty tax known as AJD. Resale homes, however, are usually subject to Property Transfer Tax (ITP), with rates varying by region and commonly ranging between 6% and 10%.

Some newly built properties are sold off-plan, meaning buyers commit to the purchase before construction has been completed. This option can provide benefits such as lower entry prices and the ability to personalise finishes or layouts.

Spanish legislation offers protection for off-plan buyers, including financial guarantees that protect deposits if the development is not delivered as agreed. Even so, working with reliable developers and independent legal professionals remains essential.

For many international investors, purchasing off-plan can be an effective way to secure a property in a sought-after area before prices increase closer to completion.

There is no single answer when choosing between a new-build and a resale property in Spain. The right decision depends entirely on the buyer’s goals and preferences.

Those looking for contemporary style, modern technology, and minimal maintenance may prefer new developments. Buyers who value character, established surroundings, and central or coastal locations may feel more drawn to resale homes.

Fortunately, Spain’s diverse property market offers strong opportunities in both sectors, making it possible to find homes suited to different lifestyles, budgets, and investment strategies.
